PATENT ABSTRACT

Described herein is a system for generating a master token to be associated with a set of tokens. In some embodiments, a number of tokens may be obtained by a communication device, which may be provided to a primary authorization computer. The primary authorization computer may generate a master token to be associated with each of those tokens. When the master token is used to complete a transaction, an authorization request may be received by the primary authorization computer that includes the master token. Upon receiving this, the primary authorization computer may obtain approval from a number of secondary authorization computers associated with the tokens, and may generate an authorization response based on those approvals.

The Examiner alleges that the claimed invention is directed to a judicial exception of certain methods of organizing human activity. Using various tokens associated with multiple users and their payment accounts to carry out the transaction is not patent eligible subject matter. Further, the claims do not include limitations that integrate the abstract idea into a practical application other than being applied on a computer. All additional elements are specified at a high level of generality to simply implement the abstract idea and are not themselves being technologically improved.

In response to the Applicants appeal brief the prior 101 rejection is withdrawn since the instant claims recite additional features and/or elements that integrate the abstract idea into a practical application of the abstract idea. The claim limitations provide an improvement over the prior system in that a single master token can carry out a transaction amongst a group of people, ensuring that only one payment method is required at the point of sale. Thus the claim is eligible because the claims as a whole integrates an abstract idea into a practical application.

The cloud computing platform can include a multitenant databasesystem that provides applications and services to a plurality of clients, and a payments platform module. Each client can be, for example, a tenant or organization of the cloud computing platform that transacts business with one or more customers via a payment gateway. The payments platform module has a pluggable architecture for integrating each of the payment gateway adapters with the cloud computing platform.

The examiner alleges that the claimed invention is directed to certain methods of organizing human activity without significantly more. Here, the additional elements, such as:“cloud computing platform” and “module” do not amount to an innovative concept since, as stated above in the step 2A, Prong 2 analysis, the claims are simply using the additional elements as a tool to carry out the abstract idea (i.e., “apply if) on a computer or computing device and/or via software programming. Limitations of the claims merely recite generic computer components at such a high level as to merely use the computer as a tool to carry out the abstract idea.

The claims recite a practical application to any alleged judicial exception as they are similar to Example 2, 34, and 42 as described in MPEP Sections 2103 through 2106.07(c). For example, the payment platform module enables clients of the system to perform payment transactions using the plurality of different respective payment gateways via the platform module of the cloud computing platform. Particularly the payment gateway adapters translate the payment APIs of the respective payments into the gateway APIs of the cloud computing platform so that they are compatible. Therefore, the claims demonstrate a solution to a technical problem by providing practical application to enable a technical advantage.

Additionally, the method includes, in response to verifying the identity of the user of the electronic device based on the obtained biometric information: identifying personal information of the user to be automatically filled into the one or more fields based on the verified identity, and inserting the identified personal information into the one or more fields for the online transaction.

The claim recites the abstract idea of verifying the identity of a user on an electronic device and transferring personal information of the user from said electronic device to various fields during an online transaction. This amounts to certain methods of organizing human activity including fundamental economic practices. Additional elements of the claims do not amount to an innovative concept since the claims are simply using the additional elements as a tool to carry out the abstract idea on a computer.

The claims as amended are not directed to an abstract idea since the claim recites a transaction method using an electronic device. Applicant notes that no art rejection has been presented and the only remaining rejection of the independent claims is under 101, and that the Applicant is denied sufficient notice of the reasons of ineligibility in order to effectively respond. No such explanation was provided as to why the claims are an abstract idea. The Office Action has not shown how an electronic device, in response to a biometric input by the user, retrieving information from a database and electronically auto-filling multiple fields of an online electronic form is a fundamental economic activity.

During the examiner interview claim amendments were discussed that would enable claims to overcome the 101 rejection. The claims have been updated to recite a data storage device with a non-transitory computer medium that inputs an account number to a transformation function that outputs a hash and then identifies the account number during payment using a reverse transformation function. Additional elements such as identifying a memory address range of the data storage device and overwriting memory address range with randomly generated data that is different from the account number also contributes to eligibility of the amended claims.
